Adoption Is One Of The Most Important Decisions
The definition of is long but in brief, it is where the legal responsibility for a child is transferred to a person or couple who are not the birth parents; it is quite normal for the child to have lost their parents and have no other surviving relatives to raise them. The adopting parents will have all the rights that the biological parents; this also means the adoptive child is granted the legal rights of a natural family member. These rights include the rights of inheritance, whether this is shared with natural offspring or not.
The adoption process must be fair to all concerned, in particular the child, so before it is finalized, the real parents must be made known to the court; this is done, in part, to assure that it is fair and lawful, and capable of withstanding any external conflicts. The naming of the biological parents can, of course, be problematic and many instances exist where this is not always possible; there are occasions where a child may be a ward of the court or their parents have died. On situation that is not straightforward is where the real mother is very young; where after the adoption takes place, all rights of a parent are removed from her.
If you are planning to adopt a child, it is mandatory for you to complete a home study before the placement is done; this is an obligatory process carried out in every US State. The home study is a document used to look into the background of the people adopting and their home environment, to ensure the child is being placed in a safe place. Part of the home study procedure surrounds background checks on the applicants; they also carefully assess the safety aspect of the home environment plus the medical records of the new parents.
If the home study is in the adoptive parents favor, a child will be matched to them and once this is done, they will only have to wait for the placement to happen. This final process is carried out by a judge who is a specialist in the family courts; he checks all the information supplied before giving agreement to allow the application to go ahead. Adoption legislation is constantly changing, both federal and state; this is why it makes sense to know the law as this knowledge will also help you learn about the responsibilities and obligations as an adoptive parent.
