The Right Decision Regarding Adoption
This is a permanent relationship that is created between one or two adults and a child formerly the son or daughter of someone else; it is quite normal for the child to have lost their parents and have no other surviving relatives to raise them. The adopting parents will have all the rights that the biological parents; the child can also expect all the rights of a member of his or her new family. The child becomes in effect a son or daughter to the person or couple adopting them with all the legal rights that entails, including inheritance.
To finalize an adoption the court must identify the biological parents of the potential adoptee; this can then prove that nothing underhand has been carried out during the process. Naming the biological parents is not always possible and is governed by state law; there are situations where the biological parents have lost access or rights to their child for instance. There are occasions where the biological parents rights are terminated at the same time as the adoption is finalized; this can happen when a child has been removed from a teenage single mother.
If you are planning to adopt a child, it is mandatory for you to complete a home study before the placement is done; all applications, irrespective of where they are made in the USA, must carry this out. The purpose of the home study is to provide proof that the adopted child will grow up in a clean, well balanced environment that is safe and secure. Many issues are checked by social workers when a home study is being carried out including whether the adopting parents have criminal records; this is also to make sure the house is physically safe as well, in addition to inspecting of medical records.
If the home study does not show anything detrimental about the potential parents then the request will be approved; they will still have to wait a while for it to actually take place however. The application is only completed when the judge who deals with family matters has had a chance to carefully inspect all the details gathered about all the parties involved. Adoption laws are always being revised, whether those of the state you reside in or federal; you would be wise to update yourself on any changes in the law before you begin the process to avoid disappointment at a later stage.
