Medical Negligence
In general the majority of medical negligence cases occur and they have very little effect if no effect to the patient. Doctors tend to be very open about mistakes made, whilst patients are normally unaware that anything has happened. There are cases where doctors are malicious and cause harm on purpose, these doctors are very rare, and never stay working for long.
Reasoning behind the negligence
If you were to ask a doctor why these “errors” occur, they would say that in many cases the explanation is simple. Doctors like everyone else are human beings and thus make mistakes when under a lot of pressure. Gross medical negligence is different and can never be explained as simply.
If you have ever been present after a surgery, then you’re sure to have heard the words “If only I hadn’t done that” Question might arise regarding the patients background and something that they missed and should of asked prior to surgery. In the majority of cases the is not anything the doctors could of done differently, but that doesn’t stop the “maybe”.
From time to time we find our personal lives slipping into our work lives, now for the majority of us this is not a problem, but for a doctor it can have serious consequences.
Litigation
Like all normal court cases medical court cases can take a long time as long as 10 years in some instances. In medical cases you have to prove two things 1. The doctor was negligent & 2. Harm was done as a result. If you do decide to go ahead with your claim, then it will be far from easy, this is to protect the integrity of the health profession and also to stop a flood of claims against doctors.
What to do next
Step One: Talk to a doctor or a nurse or a manager and explain the situation.
Step Two: Also talk to Citizens Advice; they should be able to answer any questions if they arise.
Step Three: Request an independent Interview.
